Terms of Service for World Table Applications
As an account holder at The World Table (TWT), you (the Customer) acknowledge and agree to the following terms of service which shall govern your access and use of all World Table Applications on our site or where The World Table applications are used on third-party sites. You also acknowledges that new and future features and services shall also be subject to this agreement. Acceptance of this agreement is effective upon checking the “I agree to the terms of service” checkbox during the signup process. When The World Table applications are used on third-party sites users may also be subject to specific terms and conditions of those third party sites.
THESE TERMS OF SERVICE INCLUDE SPECIFIC PROVISIONS THAT REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS FOR DISPUTE RESOLUTIONS. THIS AGREEMENT PROHIBITS CLASS ACTIONS AND JURY TRIALS, AND LIMITS THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE.
Increasing good will in online interactions, while encouraging healthy open and honest dialogue is an important goal of our products and services.The World Table PBC’s (“we,” “us,” “our”) Terms of Service are closely connected with a set of practices we call The Way of Openness. World Table users agree to adopt these simple practices in all of their interactions at The World Table.
The Way Of Openness
The Way of Openness is a set of skills and attitudes that fundamentally changes the way we see ourselves and the way we interact with others. These universally beneficial skills and attitudes include honesty, kindness, listening well, sharing the floor, presuming good will, acknowledging differences, answering tough questions, giving credit where credit is due, speaking only for yourself, and keeping private things private.
We strive to create a “safe place” for people to interact and to have real and sometimes difficult conversations. Your pledge to interact by these standards is a serious and critical part of that reality.
While using the World Table’s Site and services you are at risk of being banned if you:.
Intentionally and continually fail to abide by The Way of Openness (no one expects perfection, but some progress would be nice!);
Post pornographic, threatening, obscene, hateful, bigoted, defamatory, or libelous content;
Collect information about users, including email addresses, without their consent;
Violate any laws, third-party rights, or our Terms of Service;
Distribute or post spam, unsolicited or bulk electronic communications, or chain letters;
Take any action that undermines the integrity of TWT sites and services, third party sites and services, or other user’s experience of World Table Applications.
Description of Services:
World Table provides a platform for commenting and engagement with your website’s audience. We help our customers improve the quality of their content and commentary and increase engagement on their site by improving the tone of online commenting, while encouraging respectful and free and open expression of ideas. We do this in part by allowing participants to rate each other and their content on a set of civic virtues (respectful, helpful, honest, and likeable). Authors’ and participant’s World Table Scores help them build real credibility and goodwill that can follow them from one community (site) to any other community where The World Table commenting system is used.
Who can use World Table?
Anyone who can form a binding agreement with World Table can use the World Table Commenting System in agreement of these terms and in compliance with all local, state, national and international laws and rules and regulations. Any use of our services by persons under the age of 13 are prohibited under this agreement. Persons previously removed for breach of terms are not eligible for services.
Your license to use World Table products
Subject to the terms agreed to, we grant a limited, non-exclusive and non-transferable license to use The World Table and related products and services. This license is revocable as outlined in this agreement.
Users are solely responsible for the comments, ratings, interactions and posts made on their World Table account.
How World Table and member can use your content.
We welcome and appreciate your feedback (firstname.lastname@example.org) about our products. Feedback you provide is offered with the agreement that those ideas can be used without compensation to you.
The World Table strives to create a platform where members share honest and accurate information. We respect the intellectual property rights of others and strive to not include content that violates those rights. In accordance with the Digital Millennium Copyright Act (17 U.S.C. 512) if you have a claim of infringement please submit details in written communication to email@example.com.
We take all reasonable measures to protect the content and account information of our users. You acknowledge that The World Table cannot, however, guarantee that third parties will not be able to overcome our security measures. If you feel your account has been compromised, please contact us immediately at firstname.lastname@example.org.
The World table reserves the right to terminate or suspend the license granted to WT members.
Disclaimer of warranties and limited liability
The World Table PBC offers products on an “as is” and “as available” basis and makes no warranties of any kind with respect to our products or services provided or any data supplied thereby, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose or noninfringement. The World Table shall not be liable with respect to your use of and access to the plugin and any data provided by The World Table under any contract, negligence, strict liability or other theory for loss or inaccuracy of data or for any direct, indirect, incidental or consequential damages.
Access and Interface
Our site and services are subject to constant updates and changes. Much of the information on the site is also proprietary or is licensed to The World Table by our users or third parties. You agree that you will not use any robot, spider, scraper, or other automated means to access our sites for any purpose without our express handwritten permission..
Additionally, you agree that you will NOT:
Take any action that imposes or may impose (determined at our sole discretion) an unreasonable large load on our infrastructure;
Copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for your information) from our sites, services, or tools without TWT’s prior express written permission and the appropriate third party, as applicable; or
Interfere or attempt to interfere with the proper working of our sites, services, or tools, or any activities conducted on or with our sites, services, or tools.
If you have a dispute with one or more users, you release us (and our affiliates and third-party sites, and our and their respective officers, directors, employees, and agents) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. In entering into this release you expressly waive any protections (whether statutory or otherwise) that would otherwise limit the coverage of this release to include only those claims that you may know or suspect to exist in your favor at the time of agreeing to this release.
You agree to indemnify and hold harmless The World Table, its officers, directors, employees, suppliers, and affiliates, from and against any losses, damages, fines and expenses (including attorney’s fees and costs) arising out of or relating to any claims that you have used the Services in violation of another party’s rights, in violation of any law, in violations of any provisions of the Terms, or any other claim related to your use of the Services, except where such use is authorized by The World Table.
Any controversy or claim arising out of or relating to the Terms shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The decision of the arbitrator shall be final and unappealable. The arbitration shall be conducted in Utah and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Notwithstanding anything to the contrary, The World Table may at any time seek injunctions or other forms of equitable relief from any court of competent jurisdiction.
